As part of a sale transaction, your lawyer is typically not provided with a copy of the listing agreement and as such your lawyer would usually not be aware of the commission arrangement between you and your realtor. Your realtor’s brokerage will provide your lawyer with a copy of the commission statement a few days before closing. This statement sets out the total amount of commission plus HST. You should carefully review the commission statement to ensure that it is in line with the commission arrangement in place between you and your realtor. If you note any discrepancies, you should contact your realtor immediately and ask them to make the correction and send your lawyer a revised commission statement.
