What is a financing condition?

A financing condition is a clause that is added to the Agreement of Purchase and Sale to protect the buyer. It usually states that the Agreement of Purchase and Sale will only remain in force if the buyer secures satisfactory financing and provides waiver of the condition to the seller before a certain time.

A financing condition allows a buyer to get out of the deal during the conditional period if it does not succeed in securing financing.
