Generally speaking a matrimonial property is a property that is ordinarily occupied by a person and his or her spouse as their family residence. A couple can have more than one matrimonial home such as in circumstances where the couple, in addition to their primary home, use their cottage as their second family residence.
Specific rules govern the sale and mortgage of matrimonial homes. More specifically, when only one of the spouses is on the title to a matrimonial home, the consent of the other spouse is required in order to sell or mortgage the matrimonial home.
